These Terms and Conditions (the "Terms") govern your relationship with the operator of the online gaming and betting services made available via stakebet-au.com and associated interfaces branded as "Stake" for the purposes of Stake (collectively, the "Services"). By accessing or using any part of the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

Effective date: These Terms take effect on 1 January 2026 and supersede all prior versions for the Services as made available via stakebet-au.com.
Definitions
In these Terms, unless the context requires otherwise:
- "Account" means the personal user account you open and maintain with the Operator to access the Services.
- "Bet" or "Wager" means any amount of real or virtual funds staked on the outcome of a game, event, or market offered through the Services.
- "Bonus" means any promotional credit, free spin, free bet, cashback, or similar incentive credited to your Account subject to specific conditions.
- "Content" means all text, graphics, interfaces, information, software, and any other material displayed on or made available through the Services.
- "Operator", "we", "us", "our" means Medium Rare N.V., and where relevant its Gibraltar subsidiary Medium Rare Limited acting as payment processor.
- "Player", "User", "you", "your" means any natural person who creates an Account or otherwise accesses or uses the Services.

- "Stake", "Stake" refers to the brand and service context under which the Operator provides the Services via stakebet-au.com and does not imply that the Operator holds any Australian licence or authorisation.
- "Virtual Funds" includes any on-site balance, credits, or digital assets used for participation in games or bets within the Services.
Account Registration
Eligibility
- Age requirement: You must be at least 18 years old to register an Account. We may require evidence of your age at any time and will suspend or close Accounts where age cannot be verified.
- Legal capacity: By registering, you warrant that you have full legal capacity to enter into binding contracts in your country of residence.
- Location and Prohibited Jurisdictions: You must not create or use an Account if you are located in a Prohibited Jurisdiction, including Australia. You must not use VPNs, proxies, or other tools to disguise your true location.
Registration Process and KYC
- Account creation: To open an Account, you must provide at least a valid email address, choose a secure password, and supply other information requested in the registration form. You may be required to verify your email address via a confirmation link.
- Know Your Customer (KYC): At any time (including after you begin using the Services), we may request:
- Government-issued photo identification;
- Proof of address (e.g. utility bill, bank statement);
- Proof of ownership of payment methods used; and
- Any additional documentation required under anti-money laundering, counter-terrorism financing, or sanctions laws.
User Obligations
- Accuracy of data: You must provide accurate, complete, and up-to-date information and promptly update your details if they change. The use of aliases, fictitious names, or another person's details is prohibited.
- Password and security: You are solely responsible for maintaining the confidentiality of your login credentials and for all activities carried out under your Account. You must:
- Choose a strong and unique password;
- Not share your credentials with any third party; and
- Notify us immediately if you suspect unauthorised access.
- One Account policy: You may hold only one Account with the Operator. Multiple or duplicate Accounts may be closed, and associated balances may be frozen pending investigation.
- Compliance with laws: You are responsible for ensuring that your use of the Services is lawful in your jurisdiction. This includes complying with the Interactive Gambling Act 2001 (Cth) and any ACMA directions if you are in or connected with Australia.
Betting & Gameplay Rules
General Rules for Placing Bets
- Offer and acceptance: A Bet is accepted when it has been processed by our servers and appears in your betting history. Until acceptance, we may refuse or limit any proposed Bet without giving a reason.
- Minimum and maximum stakes: Each game or market will display applicable minimum and maximum stake limits. We may adjust these limits at any time and may set individual limits on your Account for risk management or regulatory reasons.
- Accuracy of information: It is your responsibility to check that the details of your Bet (including selection, odds, stake, and market) are correct before confirming. Once accepted, a Bet cannot ordinarily be cancelled or amended.
- Settlement of bets: Bets are settled based on the official result of the relevant event or the game outcome as determined by our systems and rules. In case of clear and obvious error (for example, wrong odds, incorrect event data, or technical malfunction), we may void affected Bets or settle them at corrected odds.
Cancellation, Voiding, and Modification
- User-initiated cancellation: After a Bet has been accepted, you have no automatic right to cancel it. Any ex gratia cancellation or cash-out feature is at our sole discretion and subject to the specific rules of the relevant product.
- Operator-initiated voiding: We may void a Bet (in whole or in part) if:
- The Bet was placed or settled as a result of a technical fault or manifest error;
- The event was cancelled, materially rescheduled, or otherwise void under the product rules;
- You breached these Terms, including by using prohibited software, insider information, or collusion; or
- Required by applicable law or regulator (including ACMA blocking or directions affecting access from Australia).
Gameplay Conduct and Chat Rules
- Fair play: You must not engage in any activity that gives you an unfair advantage or compromises the integrity of the games or markets, including:
- Using bots, scripts, or automated betting software;
- Colluding with other Players or sharing confidential information;
- Exploiting bugs, loopholes, or technical vulnerabilities; or
- Engaging in arbitrage strategies that rely on system delays or errors.
- Live casino and chat behaviour: In live casino environments, forums, or chats, you must:
- Refrain from insults, hate speech, harassment, or abusive language;
- Not promote illegal activities, including evasion of ACMA blocking or other regulatory controls;
- Not advertise third-party services or competing websites; and
- Respect other Players, dealers, and staff.
- Responsible gambling: You should only wager funds you can afford to lose. We encourage the use of voluntary limits, time-outs, and self-exclusion tools where available.
Bonus Terms
Activation and Eligibility
- Offer-specific rules: Each Bonus or promotion published on stakebet-au.com is governed by its own specific terms ("Bonus Rules"), including eligibility criteria, minimum deposits, maximum rewards, and wagering requirements. In the event of inconsistency, the Bonus Rules prevail over this section.
- Eligibility: Bonuses are personal, non-transferable, and may be restricted to certain countries, currencies, or user segments. Users located in, or accessing from, Australia or any other Prohibited Jurisdiction are not eligible for Bonuses tied to real-money play.
- Activation: A Bonus may require you to:
- Opt in via the promotions page or Account settings;
- Enter a promo code; and/or
- Meet a specified minimum qualifying deposit or Bet.
Wagering Requirements and Timeframes
- Wagering: Unless stated otherwise in the Bonus Rules, you must wager the Bonus amount, or the Bonus plus deposit amount, a specified number of times before:
- Withdrawing any associated winnings; or
- Transferring Bonus funds to your withdrawable balance.
- Contribution of games: Different games may contribute differently towards wagering requirements (for example, slots 100%, table games or live casino 10 - 20%, or excluded entirely). The applicable contribution rates will be set out in the Bonus Rules.
- Time limits: Bonuses and their wagering requirements must typically be completed within a specified period (for example, 7, 14, or 30 days) from activation. Bonuses not fully wagered within the stated timeframe may expire, and any associated winnings may be forfeited.
Prohibited Actions and Combining Promotions
- Prohibited Bonus abuse: We may withhold, cancel, or reclaim Bonuses and associated winnings if we reasonably suspect:

- Risk-free or low-risk betting patterns designed solely to unlock Bonuses;
- Collusion or syndicate betting; or
- Use of VPNs, proxies, or other methods to circumvent geographic or eligibility restrictions, including Australian restrictions.
- Combining promotions: Unless expressly allowed in the Bonus Rules, you may not combine multiple Bonuses on the same deposit, game, or Bet. Only one active wagering requirement normally applies at any time, and wagering may be applied in a set sequence.
- Operator discretion: We reserve the right to modify, suspend, or withdraw any Bonus or promotion at any time, including to comply with legal or regulatory requirements in 2026 or later, provided that such changes do not adversely affect Bonuses already accepted by you without giving you a reasonable opportunity to complete the promotion or cancel it.
Payments & Withdrawals
Deposit Methods and Conditions
- Available methods: Subject to your location and our internal policies, you may be able to deposit using:

Withdrawals
- General: Withdrawals are, where permitted by law, processed back to the original deposit method or another verified method in your name. Minimum and maximum withdrawal limits apply and may vary by method and currency.
- Verification: Before approving a withdrawal, we may:

- Cryptocurrency transactions: For digital assets, you are responsible for providing an accurate wallet address and network. We are not liable for loss of funds resulting from incorrect addresses, unsupported networks, or user error.
- Australian law: If we determine that you are in Australia or another Prohibited Jurisdiction, we may restrict or refuse withdrawals until we have clarified your status, complied with any regulatory obligations, and determined our legal position regarding any remaining balance.
Refunds, Chargebacks, and Reversals
- Refunds: Deposits are generally non-refundable once used for wagering. In exceptional circumstances, and at our sole discretion, we may consider a refund request for unused deposits, subject to enhanced due diligence and subject to not contravening applicable law or regulatory directions.
- Chargebacks: Initiating a chargeback or payment reversal without valid legal justification is a breach of these Terms. We may:
- Deduct the disputed amount and any associated fees from your balance;
- Close or suspend your Account; and
- Report the matter to relevant authorities or payment providers.
- Bonuses in refunds: Where a Bet or Bonus is voided or refunded due to technical error or regulatory requirement, we may remove any associated Bonus funds or winnings from your balance.
Limitation of Liability

- Maximum liability: Our total aggregate liability to you for any single event or series of related events shall not exceed the amount of the Bet or Wager that gave rise to the claim, or, where no Bet is involved, the total amount of your deposits directly related to the claim, subject always to any non-excludable statutory rights you may have.
- Australian consumer law: Nothing in these Terms excludes, restricts, or modifies any warranties, guarantees, or rights that cannot lawfully be excluded under applicable consumer protection laws, including, where relevant, the Australian Consumer Law. Where such rights cannot be excluded but may be limited, our liability is limited to the minimum extent permitted by law.
Intellectual Property Rights
Ownership
- Operator IP: All intellectual property rights in and to the Services, including all software, source code, databases, trademarks, trade names (including "Stake"), logos, designs, graphics, text, and audiovisual content available on stakebet-au.com, are owned by or licensed to the Operator and protected by copyright, trademark, and other intellectual property laws.
- Licence to use: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for personal, non-commercial entertainment purposes only.
Prohibited Uses
- No unauthorised copying: You must not copy, reproduce, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on any part of the Services, except to the extent expressly permitted by applicable law.
- No distribution: You must not distribute, transmit, publish, sell, rent, lease, or otherwise exploit any part of the Services or the underlying software without our prior written consent.

Privacy & Data Protection

Changes to Terms
Amendment Procedure
- Right to update: We may modify or update these Terms from time to time, including to reflect changes in law, regulatory guidance, industry practice, or our business operations in or after 2026.
- Notification: Where changes are material, we will use reasonable efforts to notify you in advance by:
- Posting the updated Terms on stakebet-au.com with a revised "Effective date"; and/or
- Displaying an in-site banner or pop-up; and/or
- Sending an email to the address registered to your Account, where available.
Acceptance of Changes
- Continued use: By continuing to access or use the Services after updated Terms have taken effect, you will be deemed to have accepted the changes.
- If you disagree: If you do not accept the updated Terms, you must stop using the Services immediately and may request closure of your Account in accordance with the "Termination & Suspension" section. Any outstanding Bets will be settled according to the Terms in force at the time the Bet was placed, to the extent permitted by law.
Termination & Suspension
Operator's Right to Suspend or Close Accounts
- Grounds for action: We may suspend or close your Account, restrict access to the Services, or withhold funds where we reasonably suspect or determine that:
- You have breached these Terms or any game-specific or Bonus rules;
- You are under 18 years of age;
- You have opened multiple or duplicate Accounts;
- You are located in, or acting on behalf of a person in, a Prohibited Jurisdiction (including Australia) or are attempting to circumvent geographic restrictions;
- Your transactions are linked to fraud, money laundering, terrorist financing, or other unlawful activity; or
- We are required to do so by law, a court order, or a competent authority (including ACMA or an equivalent regulator).
- Notice: Where legally and practically possible, we will notify you of the suspension or closure and the reasons for it. However, we may be prevented from giving detailed reasons in some cases (for example, where prohibited by law or investigative secrecy requirements).
Effect of Termination on Funds
- Outstanding Bets: On Account closure, outstanding Bets may be settled in accordance with the applicable rules, unless voiding is required by these Terms or by law.
- Balance payout: Subject to any legal or regulatory hold, we will pay out any remaining legitimate balance to you using an appropriate payment method in your name. We may withhold funds to the extent necessary to:
- Recover chargebacks, reversed deposits, or unpaid fees;
- Comply with AML and sanctions obligations; or
- Address Bonus abuse or fraud.
- User-initiated closure: You may request closure of your Account at any time by contacting customer support. We may require additional verification before processing closure and any related withdrawals.
Governing Law & Jurisdiction
Applicable Law
- Primary governing law: These Terms and any contractual or non-contractual disputes arising out of or in connection with them are governed by the laws of Curaçao, without giving effect to any conflict of law rules.
- Mandatory local rights: Nothing in these Terms affects any mandatory provisions of the laws of your country of residence which apply to you and cannot be derogated from by agreement, including, where applicable, consumer protection laws such as the Australian Consumer Law. Dispute Resolution
- Internal complaints: If you have a complaint, you should first contact our customer support team via the channels specified on stakebet-au.com, providing full details of the issue. We will investigate and attempt to resolve your complaint in a fair and timely manner.
- Regulatory escalation (Curaçao): If you are dissatisfied with our response and your dispute concerns the fairness of the games or our conduct under the Curaçao licence, you may be able to submit a complaint to the relevant Curaçao authority or portal identified in our licensing information, including the consumer complaints channel at https://gamingcontrolcuracao.org/consumer-complaints, subject to their procedures.
- Court jurisdiction: Subject to any applicable mandatory consumer rights, any dispute that cannot be resolved through internal procedures or regulatory escalation shall be submitted to the competent courts of Curaçao, and you irrevocably submit to the jurisdiction of those courts in respect of such disputes.
